I Am Selling My Property – What Is Expected Of Me?

As the Seller, there are a number of obligations which you will need to fulfil in order to assist the Conveyancing Attorney in attending to the transfer timeously and with ease which include:

  • Furnishing us with the documentation which is requested from you as quickly as possible.
  • Furnishing us with the correct bond account number if you have bond or, if there is no bond, with the original Title Deed as soon as possible.
  • Paying to us the amount that is required to enable us to obtain the Rates Clearance Certificate from the Municipality without delay.
  • Making yourself available as quickly as possible to sign the necessary documentation when called upon to do so.
  • To attend to any work on the property that you have undertaken to do as quickly as possible.

I Am Buying A Property – What Is Expected Of Me?

As the Purchaser, there are a number of obligations which you will need to fulfil in order to assist the Conveyancing Attorney in attending to the transfer timeously and with ease which include:

  • Furnishing us the documentation which is requested from you as quickly as possible.
  • Ensuring that you understand what you have undertaken to pay, when payment is due and to attend to such payments. These payments may include the payment of the deposit, transfer costs and occupational interest. These payments must be made to the Conveyancing Attorney when you are called upon to make them.
  • If you are applying for a bond, do so timeously and furnish the bank or bond originator with all the necessary documentation when called upon to do so.
  • If you are successful in applying for a bond another Conveyancing Attorney, referred to as the Bond Attorney will be appointed to prepare the bond documents for you on behalf of the bank.
  • Providing the Bond Attorneys with the documentation that is requested from you as quickly as possible.
  • Ensuring that the bank provides the necessary payment guarantees if provision is made for this in the Offer to Purchase.
  • Making yourself available as quickly as possible to sign the necessary bond documents when called upon to do so.
  • Making yourself available as quickly as possible to sign the necessary documentation when called upon by the Transfer Attorney to do so.
  • Understanding that the Offer to Purchase will likely make provision for you to have purchased the property ‘voetstoots’ meaning that if you find any defects in the property after registration has taken place, they will likely be regarded without sympathy.
